DC Councilmember to Introduce Bill Limiting Rental Late Fees
A home for rent on Capitol Hill.
On Tuesday, DC Councilmember Anita Bonds will introduce a bill that limits rental late fees to no more than 5 percent of a tenant’s monthly rent in the District.
Currently, there is no law in the city that governs the fees that landlords can charge tenants who do not pay their rent in a timely manner. The bill introduced on Tuesday would make the maximum fee that could be charged 5 percent of the monthly rent owed.

“The bill [also] prohibits a housing provider from deducting a late fee from future rent payments, which can cause timely rental payments to be late if the tenant has not yet paid the original late fee,” a press release about the legislation stated. “Currently, some housing providers charge a late fee not only in the month when the payment is missed, but each month thereafter until the tenant becomes current on all late fees.”
A late payment, as defined by the proposed legislation, is “any amount of rent that is not paid within ten days from the time a rent payment is due.”
