Montgomery County Passes Bill to Require Radon Testing For Home Sales

Montgomery County is now the first county in the country to require radon testing as part of a home sale transaction.
The County Council unanimously approved a bill that will require most single-family homes to be tested for radon prior to be being sold. The bill will take effect in October 2016.
“A single-family home located in the County must be tested for radon before completing the sale,” according to the bill text. “The radon test must be performed less than one year before the settlement date. The seller must either perform the test or permit the buyer to perform the test. Both the seller and the buyer must receive a copy of the results.”
Currently, a home seller in Montgomery County must disclose the existence radon if they have that knowledge, but the law does not require a seller to determine if radon exists.
