Arlington Planning Commission Unanimously Supports Allowing Renters to Host on Airbnb

Last week, UrbanTurf reported that Arlington County had begun allowing homeowners to apply to create accessory homestays, a new home occupation designation that permits short-term rentals of fewer than 30 days.
Now, the County appears poised to extend these new permissions to renters as well.

On Tuesday night, the County Planning Commission voted unanimously to change the language throughout the new bill from “owner” to “resident”, giving lessees the ability to list their primary residences on sites like Airbnb. A renter whose lease expressly forbids these sort of sublets would still be bound by the terms of their lease over this new provision.
As of January 13th, 27 individuals had applied to utilize their home as an accessory homestay; 22 of these applications have already been approved. Out of these applications, five were for units in multi-family buildings.
The bill’s amendment also removes limitations on the number of contracts per night, allowing guests with separate contracts to rent simultaneously if overall occupancy limits are still observed. The full County Board will consider whether to pass these revisions on January 28th.
